Foreigners who exceed the permitted time of stay in Brazil, either by exceeding the limit as a tourist or by remaining in the country with an expired visa or residence permit, may be fined by the Brazilian immigration authorities. Payment of this fine can be made through a bank account in Brazil or by international transfer via SWIFT. However, and most importantly, the visitor or immigrant has the right to present a defense and appeal before paying the fine. The application of the penalty is not automatic or immediate, it must respect due legal process, and can only be formally imposed through an infraction notice, duly notified. The foreigner has the right to defend himself and question the legality of the fine within the administrative migration process.
