The Federal Supreme Court made a historic decision, allowing the recognition of acts of homophobia and transphobia as a crime of racial insult.

Overview

The Federal Supreme Court made a historic decision, allowing the recognition of acts of homophobia and transphobia as a crime of racial insult. This decision was made by an overwhelming majority of 9 votes to 1. In 2019, the STF had already classified this type of discrimination as a crime of racism. However, the Brazilian Association of Lesbians, Gays, Bisexuals, Transvestites, Transsexuals and Intersexes (ABGLT) argued that judges adopted an understanding that made it impossible to punish individual offenses. Now, with this decision, acts of discrimination against LGBTQIA+ people will be punished as the 2019 decision predicted, in a more severe way, providing greater protection for LGBTQIA+ people. Equating the crimes of racism with racial insults is also a crucial step in the fight against homophobia and transphobia in Brazil. The STF's decision represents a significant advance in the search for equality and respect for diversity. It is a reminder that justice and fundamental rights must prevail.
