Overview

The Consular Declaration of Civil Status is a document issued by the consulate general with the aim of certifying the marital status of Brazilian individuals abroad. In addition to serving as official proof of marital status, this declaration is crucial to formalize Brazilian marriages held outside the country. If two Brazilians or a Brazilian and a foreigner are getting married abroad, it will be important to obtain this document from the consulate that serves the region. Under Brazilian legislation, marriages celebrated by foreign authorities are recognized as valid, ensuring that Brazilian citizens married abroad have their marital status also recognized in Brazil. Any inconsistency in declaring marital status, such as falsely claiming to be single when married, can result in serious legal consequences. Under Brazilian law, such conduct is considered ideological falsehood and, if it results in a second marriage, it constitutes the crime of bigamy. These violations may lead to the annulment of all legal acts resulting from the false information provided.
